As for the printer, we need to clarify on which part of the printer, you wish to be protected.

Generally speaking, mere ideas and concepts are not subject to protection. We do not protect things which have yet to be materialized.

Nevertheless, if it is the appearance ie the design of the printer itself, yes, it could be protected under Industrial Design.

Likewise, if the concept you were referring to is actually the function of the printer, it may be protected under Patent.

But then again, these are just the general concepts of IP. Each and every component of IP has their own special features and requirements which need to be met. Until and unless the conditions are fulfilled, the product, although at the initial instance may appear as though it may be protected, it could finally be otherwise.

We need to look into the products itself to identify the specific protection you wish to seek from us.

Dear Sir,
In order to register IP for a product, there are two type of registration involved which namely Trademark and Industrial Design registration.  A trade mark is a sign which distinguishes the goods and services of one trader from those of another.  A mark includes words, logos, pictures names, letters, numbers or a combination of these.

Attached are the needed documents for trade mark application "-
- 5 copies of the completed TM5 with trade mark affixed to each copy
- 1 original copy of the statutory declaration with trade mark affixed to it
- the trade mark size must not exceed 10cm x 10 cm
- 1 copy of the Form 49/Form D/company detail from company registrar if the registration is made under company name
- 1 copy of priority date claim document (if necessary)
- 1 copy of certified transliteration and translation if the trade mark is in other than roman character form (if necessary)
-  the payment is RM370.00/RM330.00 (online) per application, all payment can be made by cash/check/money order/bank   draft to "Perbadanan Harta Intelek Malaysia"

** If the application been approved, Acceptance Letter (TM31) will be issued and applicant need to pay for RM650.00/RM600.00 (online) for gazette purposes. Protection for trade mark valid for 10 years and renewable for every 10 years.

Besides of that, you may also apply for industrial design registration for packaging of the product.  An Industrial Design is the ornamental or aesthetic aspect of an article. The design may consist of three-dimensional features such as the shape and configuration of an article, or two-dimensional features such as the shape and configuration of an article, or two-dimensional features, such as pattern and ornamentation.  The design features must be applied to an article by any industrial process or means of which the features in the finished article appeal to eye.

Step to apply Industrial Design
- Filing Form ID1 (Fee: RM500/480 (online) for single application and for next subsequent multi application RM500/480 (online) per appl.
- View of the representation in drawing or photography in one copy (Fee:RM200 (manual or online) for each view
- Filing SJAR - Statement Justifying Applicant's Right
- Statement of Novelty
-Submit the application to MyIPO or by online with cash/check/money order/bank draft to "Perbadanan Harta Intelek Malaysia"

Yes, the manual may be copyrighted before the website is developed.

Yes, it will be recognised internationally.

The copyright title is of immediate effect. =)

As per the procedures, there are forms to be filled and fees to be paid.

In light of Copyright protection, generally, the Law does not give protection on mere ideas. This is due to anybody can come out with any ideas and no implementation is carried out, thereby we have no source of telling if the idea is fresh and new.

Hence, idea per se, is not protected.

Nevertheless, Copyright does give protection to real works such as books, paintings, websites and such.

Thereby, if you wish your website to be protected, it is in the best of your interest to write the plans in a manual, and get it protected by applying its registration in MyIPO.

Later, when the website itself has been developed, it can also be protected.

And of course, everything depends on the originality of the works.
